SIEC, Actualidad Etnica, Diciembre 16 de 2008. El Presidente de la Comisión de Derechos Humanos del Senado de la República, denunció ante la opinión pública internacional y nacional y ante el Congreso de Colombia la ejecución extrajudicial del ciudadano y comunero indígena, Edwin Legarda, en la vía Inza - Totoro, Finca San Miguel, vereda Gabriel López del municipio de Totoró, departamento del Cauca.
Señaló que según los indígenas, la víctima fue abaleada por tropas del Ejército Nacional, adscritas a la 3ra Brigada, que operaban en el área y dispararon de manera repetida con armamento de guerra en contra del vehículo en que se movilizaba Edwin Legarda.
El operativo oficial que dejó como saldo al comunero indígena muerto por medio de 17 impactos de arma de fuego sobre el vehículo emboscado configura un atentado criminal más, en contra de la dirigencia indígena del Cauca, precisamente en el 17 aniversario de la masacre de 20 comuneros en la Hacienda del Nilo, en Caloto, Cauca.
Reconoció que el hecho trágico compromete de manera directa la responsabilidad del Gobierno Nacional en el manejo del orden público en esta zona del país, y su política para el tratamiento del conflicto con las comunidades indígenas, ensombrecido en el último periodo por amenazas reiteradas, abusos permanentes de la Fuerza Pública, persecuciones de tipo judicial y violaciones reiteradas de los derechos humanos, en una creciente espiral de militarización, paramilitarización y agresión hacia los territorios y jurisdicciónes indígenas por parte del Gobierno Nacional.
Exijió una respuesta oficial inmediata a las comunidades indígenas del norte del Cauca, por parte del Presidente de la República, Dr. Álvaro Uribe Vélez, en su calidad de Comandante General de las Fuerzas Militares.
El Presidente no solamente debe encabezar las acciones que conduzcan a iniciar todas las investigaciones de carácter interno, disciplinario y penal con ocasión de los hechos, sino que además debe pedir disculpas a las comunidades indígenas, al Consejo Regional Indígena, a la consejera mayor y esposa de la víctima, Aída Quilcué, quien es una destacada dirigente de la Minga indígena, la cual ha sido amenazada en múltiples ocasiones.
Solicitó garantías para todo el movimiento indígena colombiano, respeto a su autonomía y que los responsables del hecho sean puestos en manos de la justicia ordinaria.
Pidió al Presidente Uribe que defina cuál es su política en torno al movimiento indígena colombiano, pues estas comunidades sólo reciben agresiones, persecución y desatención a sus demandas.
